It's my understanding,

The Patent protection takes place for an invention as soon as the application is filed with the US patent office.

Patents last 20 years from the filing date.

Mike has one year from the first date of public use or sale to file for a patent for the Cannacig. His invention will be protected or Patent Pending.

Now, whether Mike has something to patent is another story.
Are the improvements to the Vapor Inhaler non obvious and useful and will they be applied to current patented products or something entirely new no one has seen before?

We'll see..
