I just spoke to someone from the Lehman case team of attornies at Weil. The attorney whom I spoke with seemed to be a tad bit confused on the subject, either that or he was trying to be careful about what he said. The attorney stated the stock I own are linked to sub notes and the sub notes are class 10B. So I then said "well, then that means the capital trust stock is class 10B too right"? He said "Not quite, whatever guarantees the stock has or does'nt have are linked to the sub notes but we take the position the capital trust stock is class 12". This could very well have to do with the fact that BNYM did not file claims under the guarantee as micmacpole stated.
