The defendents request for clarification? I thought all that type of thing was hammered out in the Markman hearing, which seemed to be heavily biased in the Greenshift direction. These infringers are grasping at straws or are we missing something? If we get the injuction to stop them collecting oil from the DDGS it will move talks forward faster towards an out of court settlement. My guess is common sense will prevail with some and they will just suck it up and pay the royalty and settle. ICM on the other hand I bet will drag this through 2 jury trials and as many appeals as they can over the course of years. I think they will still lose, but at that late stage, triple damages and the ammounts for years of back royalties involved they will be bankrupt, they will lose everything if they go all in. Same goes for DVG who is trying to slither his way out of the mess he personally created, he should be held personally liable.
