Logic? I would say they think that the risk of losing is very small, at least much less than the profits to be made now. Without being a patent lawyer, or at least knowing the Court of Appeal's logic, it is very hard to handicap from the outside.
Another possibility is to increase the leverage for settlement negotiations. Once the sales go away in part (due to AG and aLov), and time passes, MNTA/NVS may have more incentive to settle.
