As you know I agree with this position. As I only have one post today I will attempt to put some things in the context of the issue that you have become sensitized too as well. Before I do, I want to state categorically that I post only under one alias (moniker) Nobody12378 or RB as Nobody123789 because of some glitch on that board; I do not and will not post on Yahoo.

Last Friday night I had dinner with another intellectual property attorney who works for the federal court in DC that would hear the appeal (if there is one) from the district court that is hearing our (Greenshift's) case. Forgive me if I say "our" because although we do not have control of Greenshift it is our company; we have paid for it. Our discussion was general of course, but her position was the same as I have heard from my son, also an intellectual property attorney. They both have stated that without in-depth knowledge of what is transpiring in this case they cannot be authoritative but the general principles of getting the court's attention and forcing the bad guys to settlement are not being supported by the news “black-out” as some of us have described this dearth of information coming from the company at this time.

This increased my sense of confusion about the lack of information that was coupled with the building expectation of many that a shareholder letter was coming out this week. I asked myself what this expectation was based on? I searched the GERS website (I do not know think the previous shareholder letters are on the GERS website) and did not find anything to support this expectation and I spent some time searching other sources as well. Perhaps I am Internet dysfunctional but I could not find the source or data to support this expectation. So I emailed the company and quickly received the email that follows.

My comments: 1) There has been quite a large window in which this shareholder letter has emerged in the past and the expectation that it will occur this week is unfounded, 2) The days it was released before were Tuesday, Monday, Wednesday, and Monday, 3) This response is another measure of the company maturing before our eyes into a robust and responsive entity, 4) We do not have any assurance that a shareholder letter will be issued this year, and 5) It is our responsibility to attempt to communicate to our company issues and possible short comings whose solution may be constructive to our benefit. The assumption that KK and company have a complete perspective on all that is important is something I am finding that they do not share, and that is another sign of the maturation here as well.

I will not be able to respond to any comments today.

The Company issued shareholder letters during the past several years on February 19, 2008, January 19, 2009, March 17, 2010 and February 7, 2011.
