To conclude from the "wherefore" clause that an amended complaint has been filed is to disregard (1) the court docket, (2) the SEC pleading, (3) the other filings in the case, (4) the title of the motion at issue, and (5) perhaps most importantly, the facts set forth in the assented to motion.
