Lets say a law is passed that ALL phones from now on have to have an anti-texting while driving app installed on them right from the start. It will then indeed be free to the public, but the phone companies will still have to buy the product to put on their phones.

Same thing with computers, when you buy a PC it comes with Windows installed on it already, but microsost did not just give away the software for free.
