LOL...oh gosh.. here is how i would answer that (valid)question

If KK made that statement above to a group of 10 average people in a room, i think most if not all of those 10 people would assume he meant legally using the technology. why would they think otherwise?

I would prefer if KK did not open himslef up to any possible criticism by putting a figure out there that would require qualification to be fully understood by all. Id like to think we can take it at face value.

I personally would not qualify it as deceptive or misleading becuase of the word choice"using". It leaves room for the interpretation to go either way. If the 30% includes infringing use then the farthest I would go is to call it confusing to the investor base who have been tracking these numbers for years.
