With regards to a class action law suit, correct me if I am wrong. If the company intentionally made false misleading comments with the sole purpose being to persuade you to purchase shares in the company, you take responsibility for your losses? Im pretty sure there are laws in place to protect people from this. Its not that a company tried and failed, its that it had no intentions of actually doing what it said it was going to. If you bought a lemon car or a house that had structural damage that wasn't disclosed and you ended up losing a ton of money, would you just chalk it up as a loss? If so, your in the perfect market buying penny stocks where everything is based on word of mouth. A fool born everyday.
