Experienced investors know that a patent approval is unlikely to move the pps at all. As I stated earlier, a patent is not necessarily blocking and it surely does not seem to be slowing up any of the competitors. If you look at the facts I presented of the number of competitors already doing or completing clinical trials it is obvious that more such products will come on to the market, I understand that some desperately want to believe that the ELTP approach is the ONLY way to do it, but that just isn't the truth. Elite does not appear to have an ongoing studies with 216 so if they want to be competitive they need to get a move on.
Going back to patents, I am willing to stipulate that it is possible they will get an issued patent, but the fact that so many others have alternate ways to sequester naloxone makes the issuance less interesting. There is zero evidence in human beings that Elite's approach is superior, and if they are going to compete they will have to produce such data.
Finally, even if they have a patent, with such a minefield of other patents I wonder if ELTP have a formal freedom to operate opinion? I can't find anything like this in their filings. Such an opinion would be one safeguard against treble damages in the case of possible infringement.
