Al. You are claiming that David and Peter defrauded investors. That means they got money. You will have to show how the money went from us to them. David still has all of his shares, and Peter does not have any. So, how did they make money? If you can't do that, the SEC will not give you the time of day. Run your theory by me once. If you can prove it, I will say "Al, you are the man!". You claim he paid for at least one pump and dump. The one in Aug. cost at least $100,000. Show where that money came from, who received it, and how much David reaped and put into his accounts. Don't just tell me your theory. I want FACTS! The reports to the SEC for the quarters in question do not list stock promotions as an expense. This is basic stuff to put into a complaint to the SEC. You should be able to do that. If you can't, then you shouldn't file one and you should stop accusing him on a public forum. He could file a counter suit claiming you are ruining him and his business. I am not defending him. I am a neutral observer, just like someone on a jury would be. Convince me to find him guilty! That is all I ask! Please! No more accusations without FACTS. (Names, dates, times, places, amounts, account numbers, e-mails, etc.) Forget about what I have said. Back up your own case with FACTS.

(A FACT is something concrete, verifiable, and real. It does not require a person to use their judgement. A fact might be, it rained on Tuesday at 10AM. That can be verified by the National Weather Service. In a financial case, it would be a person made a deposit of a certain amount of money into a certain account on a certain day at a certain time. A fact is, the guy withdrew a certain amount of money from a certain account. A fact is that a person sold 1 million shares of NSAV or CXLT on a certain date for a certain price.)

Prove your case. If you can't prove it to me, you won't have a chance with the SEC. So, consider me a test run. I have an open mind. Show me what you got.
