When a company chooses to not report, and the CEO speak with shareholders, then Rule 10b can be an issue......


The form 4 filed was from Jan of 11

Those restricted shares would have been issued last year, not on 1/3/12. Didn't the CEO say something a little different last year?

Called the CEO today ,54 mil shares issued for NYTEX are restricted at least 6 months.



Of course we have no way of knowing since.......THEY FILED A 15-12G and no longer have to report!

One other thing, since NYTEX is the same in FL and NY, why does the NY filing only list 200 shares for NYTEX?
