Sure, unlike criminal proceedings, in civil proceedings in the U.S. a negative inference may be drawn against a party who refuses to testify. Have you seen any indication that "JB" has refused to testify? The continued operations of the company, without intervention from the SEC, suggests to me that the company has been cooperating and negotiating with the SEC.
You know Mr. Anslow and Mr. Jaclin? Do you have experience working with them? Please, share more of what you know of their expertise/intelligence. Anyway, while I am happy that, according to your report, Mr. Anslow and Mr. Jaclin are highly intelligent, I think you are most likely mistaken that JBI's transactional attorneys for securities filings are also JBI's litigation counsel for SEC negotiations (or any other litigation). What would lead you to believe Anslow and Jaclin are litigation counsel for JBI?
Does it matter? There is plenty of speculation out there (often stated as fact) for you to read. Here's a tip if you are looking to speculate yourself: look at the state of incorporation and the state of principle office (or the state of principle business activity).
The U.S. government called JBI executives (or "these guys") liars? Really? Can you provide us a quote on this assertion? And who has changed "their stripes" and how have said "stripes" changed?
