Are you referring to the article you posted? If so, that article has the SEC as the plantiff and EMXC as the Defendant along with the TA.
I do not see anything were EMXC took the TA to court.

What it looks like is that the SEC took them both to court and from converstaions with the TA, EMXC could not pay the bills to where the TA would produce the dividends. TA was probably holding ransom for the documents that the court ordered released with payment of bills and such to be settled later.
