Edit: Would like to add I pretty much agree with your Post, just wanted to make the Point that Cardinal MUST think, at this point that the ICM Patent is a lost cause. You are right, in some ways, they could be better off settling. One way would be to break the agreement if ICM got final denial on their "Pending" Patent! That might give them legal standing to dump the Contract, but on the downside would leave them still owing for all the "Tricanter" and affiliated equipment that ICM put in. Then they would just have to do the Math (or as I have been "Tutored" the Arithmetic!).
