The original Ruyan uses an ultrasonic atomizer. Most, so called copies, use a heating element to vaporize the liquid.

Manufactures have recently released even newer versions of the ecig in which the atomizer and flavor cartridge are contain one disposable cartridge called a Cartimizer.

Since these designs are so far removed from the original Ruyan design, would they be labeled as patent infringement?

This patent lawsuit is not so black and white. Like the electric light bulb, many patents were filed, but the technology improved through continual invention by others.
