Yes it does in most people's minds, and, in particular, is the focus of a significant number of arguments put forth by our counsel, Steinberg et al.

However, this is only in the event that one is inclined to pay attention to things like facts and the essence of the agreement. Clearly, Chamberlain never overburdened herself with such mundane things as factual information and legal documents.


Well, that's because you're overlooking the fact that Cha-Cha was taking into consideration the "totality of the circumstances."

Far be it for me to suggest that Cha-Cha had been (extensively) coached. But "totality of the circumstances" is a generally a phrase/term that prosecutors drill into cops' heads, coaching them to parrot/repeat that phrase in court, drilling it into their heads, in order so that police officers try to justify what might otherwise be an illegal stop. You know, by taking into account the "totality of the circumstances."

For example, "officer, isn't it true that you stopped my client simply because he's black?"

"Absolutely not. Race was NEVER a consideration. I simply took into account 'the totality of the circumstances' in deciding to arrest your black client, I mean, your client, Mr. Black, I mean, uh, well, I was concerned for 'officer safety' . . . you know . . . for officer safety, based on 'the totality of the circumstances.'"
