According to the professionals, most of the cost of the litigation has already been expended. From that perspective there is little incentive to settle. It is a fact that damages continue to accrue, but considering the strong likelihood that the damages may already threaten the financial viability of some/all of these companies and the fact the Court of Appeals frequently over turns (35%) of lower court decisions, there does not appear to be an incentive to settle. Our best bet is a preliminary injunction as the leverage for the settlement(s).
