If MNTA is able to succeed in receving a PI, can you argue they are in better competitive shape than the time prior to Amphastar receiving approval?

Just to clarify, the differences between my response (#msg-68236458 ) and Dew's response (#msg-68236467 ) centers on exactly which "PI" you are referring to. I think Dew's response pertains to the possibility of a preliminary injunction, which is the more near-term possibility. My response is based on the scenario wherein MNTA were to ultimately land a permanent injunction. If MNTA wins the preliminary injunction, I hope they let the trial run its course and take their chances on landing the permanent injunction.
