Q: Can I sue this guy to recover any loss the same time he was trading?

Why not calculate your damages first.

You would have to find the trades you made that were price impacted by a trade he made. So you will have to go through his records to find time matches, then look at a the time/price charts of the stock to see if you would have gotten a better price.

Given that:

A) There likely were no matches
B) An unfair price would likely not happen, and if it did would be small and could go either way

Your damages are going to nothing.
