The Commission hereby moves the Court to lift the stay again to allow the Commission to file a Second Amended Complaint. The proposed amendments add an additional defendant, James Meagher, who is alleged to have participated in the pump-and-dump scheme involving the issuer, Xtreme Motorsports of California, Inc. See First Amended Complaint at 17. Meagher was previously referenced in the Complaint and First Amended Complaint as “Accomplice No. 1” (“AN-1”).
