If that is true and it leads to MNTA receiving a royalty rather than a split of the profits, then any settlement becomes much less likely because the damage will have been done.

However, I don't see why that would be true or what Ampha's lawyers would gain by admitting that fact since any sales would probably be miniscule at this point while the potential damages -- if MNTA were to prevail -- would likely put Ampha out of business.
