EK management openly declared they are not considering BK and fraudulent transfer would not spoil patent sale. There are far too many influential stakeholder groups to let BK become a reality for EK, imo. Believe you me, behind closed doors, the patent portfolio bidding war is likely heating up by bidders with deep pockets.
