AMENDED and RESTATED 2003 agreement
Reading the Transcript(Thanks Catz)and
noticed the Creditor's lawyer pointing out these words.
Strochak seems to have a valid point re:Authenticity
of the 2002 warrant agreement therefore invoking
statue of limitations albeit in a derivative way.
Anybody care to weigh in on why signatures of
officers on the 2002 agreement isnt valid?
Does the filing of the 2003 agreement with the
S.E.C. rule the day ? Im thinking that when this came
to plantiffs attention during the discovery
of the Warrant Agent (Mellon)Perhaps it was the reason
BroadBill pulled out ?
Just seemed a little weak to say the 2002 agreement
didnt count.Very strange that WMI had no record of the 2002 warrant agreement but mellon just some how
found it .
