If KATX went broke, it would be that easy imo. Ken would probably keep the claims in his own personal name, if Vale still wanted the claims they would pay Ken directly. What leverage would Ken possibly have if KATX folded up shop? He wouldn't have any chips left, just some unproven claims that he would never be able to develope himself.
