Contract, no contract is irrelevant. Did WL authorize using the 40k sent to him? If plaintiff can prove money was utilized by the company than it's a slam dunk in court.
WL better get this legal matter done very soon and get things moving with proof of company assets to get pps moving. There are a lot of investors like myself who are going to be dumping losses prior to year end to offset gains from stocks that made them money.
