At Natcore's AGM, Provini gave the possibility of stolen technology quite a bit of time. He said, patents are only good in China if they are filed by Chinese companies. Natcore/China has filed duplicate patent applications in China, and has been assured by the Chinese patent office that they will be honored.
AMSC would have had to partner with a Chinese firm in order to file for patent protection in China and be assured that it would be upheld. There is a good possibility that they did not do this. It could be tough for AMSC to win their claim for arbitration. AMSC may have to seek help from the WTO. How much that would help, I don't know.
