Could Medizone financially withstand a PATENT challenge?

The patent titled "VAPORIZED HYDROGEN PEROXIDE DECONTAMINATION SYSTEM WITH CONCENTRATION ADJUSTMENT MODE" is but one of many patents assigned to Steris

Whatisvalue: Can Steris modify their device to deliver both substances within a relative open system without conflicting with MZEI's pending patents?

If, as has been suggested, JNJ and Bioquell currently use "elements of the same technology" that Medizone proposes to use then the question below makes a whole lot more sense than the one above.

Whatisvalue: "With JNJ and Bioquel using elements of the same technology, although not the precise formulation (which seemed to be disclosed in Zoutman's presentation), what is to keep them from spending a few million contesting a patent (if issued) vs. spending billions on acquiring MZEI?"

Of course, a patent challenge is always a possibility as evidenced below in the successful action taken by Steris against wholly owned subsidiaries of Bioquell.

"STERIS CORPORATION PROSECUTING PATENT INFRINGEMENT LAWSUIT"

"STERIS Obtains Settlement in VHP(R) Technology Patent Lawsuit."

Les C. Vinney, STERIS's President and Chief Executive Officer, stated, "STERIS's expansive patent portfolio is an extremely valuable strategic asset of our Company. The successful prosecution of this claim is indicative of our policy to aggressively protect the integrity of our intellectual property on a global basis. STERIS considers its proprietary VHP technology an integral part of its product portfolio, with validated applications for the biopharmaceutical process area, sterility testing, as well as other applications for enclosures, barrier isolators, and clean rooms. We believe our VHP technology will play a critical part in the continuing development of STERIS applications to meet the processing needs of the markets that we serve."

More recently is the previously cited example of THIS PATENT being successfully challenged.

"DAYTON — Advanced Disinfection Technologies LLC, which does business as ADTec, filed for Chapter 7 bankruptcy Feb. 7 in U.S. Bankruptcy Court.

The business, 2996 Henkle Drive, Suite J, in Lebanon, listed assets of under $50,000 and liabilities of between $1 million and $10 million.

Neither Jeffrey Szekely, the company’s president, nor Howard S. Levy, the company’s attorney, could immediately be reached for comment.

An employee, Vivien Carmichael, said the business was “winding down” operations. She said the company has been dealing with a patent infringement lawsuit.

According to its website, adtecbio.com, ADTec develops, patents and brings to market innovative disinfection products. It started operations in 2008.

Chapter 7 bankruptcy filings usually lead to the liquidation of a company."

Whatisvalue: "Clearly, as you reference, Steris, Bioquel and others are working on a solution to the problem of bacteria in medicine. The mere existance of fact that such work is being done doesn't in and of itself identify a sufficiency of expertise or effect that would necessarily result in competition to MZEI."

Bioquell, Sixlog and others have developed their respective technology, some for over a decade, to a level that has received acceptance in the marketplace.

Medizone may be considered opposition but competition, really?

Whatisvalue: "I won't get into how mucked-up I see the current sales effort to be and how that may only complicate matters."

Who presides over and is responsible for the mucked-up current sales effort?

Somebody inept?

Five weeks since FIME with one or two orders, no sales, no product, with questionable manufacturing capability, no US hospital testing and shareholders still continue to embrace Marshall?

Incredible!

Quote: "I have little doubt that competent patent counsel would be unaware of the matters and examples you raise and have notified MZEI management accordingly."

Competent and AWARE would be preferable
