I can't decide who is more in the right here, as both sides have reasonable arguments. Direct Response is privately held and partly owned by Jupiter Media. I doubt THK has the cash to simply buy them out, so the dispute will be litigated. Any poaching of customers from DirectResponse or copying of software should be off-limits for THK. I don't know why they can't simply agree to that??
