We have no idea if you actually called him, talked to him. Even if you did, context is everything. Was it "Refuses," or was it "hasn't returned them yet," or "is working on getting them together." What is the exact purported language he apparently used? Did you ask him what his plan was to get the financials back? Did you ask him if there are other copies available? The lack of information undermines the credibility.
