Great email Response RE: Patents

XXXXXXXXXXX,

Thanks for your support of Pharmstar Pharmaceuticals. We appreciate it.

While I am not a patent attorney, I will try to help you understand the patents.

The earlier patents that have been released to the public domain were earlier versions of what we now call Aquaprin. Each subsequent patent is an improvement on the previous one, and the most recent patent, that is pending, is another improvement....and as any additional improvements are made, more patents would be filed. Howard retains all rights to his formula worldwide, and never intends to enter into any agreement that would let another company make the product for him. I like to use the analogy of Coca Cola....they have a secret that no one has ever been able to duplicate, no matter how hard they try. While the formula for cola drinks is widely known, Coca Cola is closely guarded. With Aquaprin, the combination of the ingredients is widely known, the process of what makes it special is not...and Howard intends to keep it that way.

In understanding patents, when a patent is pending, it does not have to be released to the public domain. It used to be that it could be held in a pending status indefinitely, but the rules have since changes that there is a finite period before it has to be released. Nonetheless, there should be no way that another company can come in and make slight changes, and market a like product.

Certainly the company will keep shareholders and the market abreast of the upcoming tour. Once a slate of events is finalized, we will make sure that anyone who wants to see and hear Howard will have the opportunity to do so.

Thanks for your interesting questions.

Sincerely,

Tommy Johnson

Subject: Aquaprin Patents

Dear Sirs,

I am a happy shareholder and was wondering about the patents for Aquaprin.

If I understand correctly, patent #5723453 is the patent for the actual composition of Aquaprin, while patent #5665388 is the patent for the method of manufacturing Aquaprin, et al.
I know the patent for the Instaprin device is still being reviewed and is in application form only.

However, in the valuation for the patents, the statement was made that the Aquaprin patent was still in process and was not approved yet. Would that be the trademark for the Aquaprin and Instaprin name or are there further patents pending for the formula itself?

Also, are these patents full patents covering the rights of all forms of Aquaprin so that only Pharmstar Pharmaceuticals may produce them – or have the rights to permit others to do so?
The purpose of this question is that I am wondering if any other pharmaceuticals can make slight adjustments to Aquaprin’s formula and manufacture basically the same product under a different name?

Thanks for your clarification.

Also, since I am writing you, I certainly would hope that there will be a good PR campaign to kick off the trip of Mr. Phykitt to the various cities to promote Aquaprin to the doctors. We are aware that it will happen, but don’t know when, where, or any of the details. Of course, if these are still in the planning stages, I would understand why. I am hoping that a strong PR blitz and even an update as Mr. Phykitt travels to different places will bring more eyes and investors to this tremendous opportunity.

Sincerely,

This is you, if you don't do your DD for yourself - so don't just listen to me!
