Political rancour enemy of pipeline

Any day now, the U.S. State Department will release a final environmental impact statement on the proposed Keystone XL oil pipeline from Alberta to Texas, a step in the approval process that proponent TransCanada Corp. and the large part of the Canadian economy dependent on oil sands growth hope will lead to a permit by the end of the year.
The developments have resulted in “a very concerned Canadian embassy and a very concerned Alberta/Washington office. I think they are doing everything that they possibly can,” Mr. Corcoran said in an interview.
Publicly, TransCanada and the oil industry continue to assume the project will be permitted. Among the optimists is former U.S. Ambassador to Canada David Wilkins, who also represents Canadian energy interests in Washington.
“It would be contrary to North American energy security to say ‘no’ to this pipeline,” he said. “It would be contrary to job creation, which is so important to the United States right now. This is a chance to have a state-of-the-art system that would be a model for others. There are a lot of positive things that indicate to me that the State Department will approve the permit.”
There’s even more on the line for Canada, where the next phase of oil sands growth is being planned. Already, those plans have been weakened by softer oil prices and a slowing global economy.
“We are keenly, as an industry, waiting for the U.S. to make up their mind on the Keystone pipeline so we can move more of our oil down to the U.S. to get to market,” said Bill Andrew, who retired last week as the president and CEO of oil producer Penn West Petroleum Ltd. “With that and a decent oil price the oil sands will have another boom, which will be great for the province and for Canada. If it goes sideways, if the price goes down, then you start trimming.”
Mr. Andrew said Keystone and the oil price will weigh heavily on budget plans for 2012, which will be firmed up over the next few months.
Trouble is, there are few options to Keystone XL and none as attractive as a bullet line linking the oil sands to refineries in the Gulf Coast. As one industry insider put it, assumption that the pipeline will get a permit is so entrenched that if it doesn’t get approved, “we’re screwed.”
It’s an unusual all-or-nothing bet by the oil industry, which usually makes sure it has a fall-back position — for example, the Alaska gas pipeline competed with the Mackenzie gas pipeline to move Arctic gas; the Northern Gateway pipeline and the Trans Mountain pipeline are both proposing to move oil sands oil to the West Coast.

If you are a potentially affected landowner receiving this notice, you may be contacted by the project proponent about permission to conduct surveys, and the acquisition of an easement to construct, operate, and maintain the planned facilities. The project proponent would seek to negotiate a mutually acceptable easement agreement. If the project is approved by the Commission, that approval conveys with it the right of eminent domain for securing facility easements. Therefore, if easement negotiations fail to produce an agreement, the project proponent could initiate condemnation proceedings where compensation for the necessary easement would be determined in accordance with state law.
