Seems asking for a continuance might be out of the picture in this civil case. There is really no reason to ask for one at this point. Discovery is over and I don't particularly see what else could be provided that would need a continuance, this isn't a criminal case. Calypso already has their case put together. The Daic parties aren't sure what they will have as far as a case goes, until the judge rules on Markle's motion.I doubt the judge is going to allow any additional discovery at this point. With the number of cases dwindling prior to the court date it is very likely Calypso will get their day in court. If I were the Daic parties I'd be looking to see what type of case I had without the subsequent filings Markle is attempting to prohibit. If they do that, then there most reasonable course of action should be to attempt settlement.
