I guess the question is .. How did they claim the exemption in the first place? If it was legal when they did it, the guy has no claim. If it was illegal then there may be an argument. Contesting regulatory lending practices comes into the picture. If thats true then the Regulations in place at the time of the execption filings must be examined and if the banks followed the rules and guidelines then thats the way it is. Let the deeds dude call uncle Sam and file a complaint with them and leave the bank alone.

I guess the register of deeds needs to do some discovery.
