I ask because a claim has been made that a large percentage of the O/S are held, presumably, by long-term shareholders on this board. That doesn't jive with the selling that has taken place and I don't subscribe to the notion that shorts are targeting this stock. I believe the company is directly or indirectly selling shares, leading to dilution. I base this on a slew of inconsistent information released by the company, indicating a less-than-honest CEO. Look, for example, at their profit and loss statement for the 3 quarters ending September 30, 2010. There is no expense related to the cost of the goods that this company is reportedly in the business of selling. Don't you find that odd? The weighted average shares outstanding still bothers me, too. The math doesn't pan out, even with a restricted meaning of 'outstanding.'

Now, if the common shares are non-voting, then 13Ds are not required, and I stand corrected. But I haven't been able to track down the SEC filing that would state whether the shares are voting or non-voting. I don't think that designation hinges on which exchange the shares trade on.
