As it stands the courts have made it okay to for people to say "I can break the law because I give the government their cut." and stand on the 5th increasing their social security benefits with criminal profits and retire a happy ol' G big smile

Apparently the author of that article doesn't see eye to eye with the proposition either.

In consequence, in the author’s opinion, the obligation to declare illegally earned income is indirect self-incrimination and therefore contrary to the Fifth Amendment. If there are no obligation to declare the income, however, the crime of tax evasion cannot be committed.



The government, in this instance, could seize the opportunity to lead by example refusing to profit from illegal proceeds and honoring the 5th amendment to our constitution.

The government, in this current form, is constitutionally incabable of developing a manner of governing that requires rigorous honesty.
