The NIR/ITRO "settlement terms" look pretty clear to me.

IT IS HEREBY STIPULATED AND AGREED.

Defendants shall pay plaintiffs and their designated affiliates
$8,018,315.00 (the settlement amount), PAYABLE THROUGH THE DELIVERY OF SHARES OF STOCK, commencing May 4 2011.....etc.
