Very true. The product is a tobacco product.

If they wanted to market it as a "quit smoking" product or carry any therapeutic claims whatsoever the FDA would regulate it is a drug. Which would need pre-market approval to be sold. (which would cost millions of dollars in studies/clinical trials/etc)

So therefor SFIO must follow the regulations of marketing it as a tobacco product.
