The FDA ruling is recent... Many of these commercials are old - the first one being from 2009.

The only way a company can legally advertise an ecig on a commercial now is if it does not contain nicotine.

Ecigs will be regulated under the Family Smoking Prevention and Tobacco Control Act which means the FDA has governing roles on how they can be advertised.
