You've done very thorough research, and I trust your opinion (to an extent) in certain matters. With this matter, I don't think it is as clear as you believe. The writing isn't on the wall simply because of this exclusion. For every plausible explanation you have for the exclusion, there are 3 reasonable explanations that argue the contrary.

At this point, only time will tell. Let it ride Timmy. If it is in fact a P&D as you believe, then it will be one of epic proportions and you will stand to make a very good short, right? IMO, you're shooting yourself in the foot by trying to play the superhero AND the villain in this scenario.
