Perhaps after investigating this FINRA ordered Penson to create a list of companies where they, and as a result the companies they cleared for, had a large financial exposure by virtue of being short.

Perhaps not. There's no sign that FINRA took EIGH's shorting nonsense seriously. And it seems they didn't like that proposed corporate action, either.
