Not to worry. The IPP's know a losing battle when they see one. Most of their "claims" were withdrawn during the hearing when asked to substantiate their "claims" with documents from their own operations. Rather than risk a finding of attempting to defraud the commission, they withdrew their assertions. This process would involve a huge expense to the IPP's and without a good chance at success, no way they will even attempt it.
Remember, only 10% of any appeals are allowed to move forward in any type of proceeding and of those, only 10% are ever successful. So you are looking at a 1% chance with good cause, and based on J.E.'s arguments, that comes down to 0% as he lacks a good argument. Reminds me of his claim that he thought would win the day on how a spark from the Berlin facility would burn down the entire town because the town was a tinder box. LMAO.
Let us not forget that the whole reason to incude the "concerns" each intervenor raised during the process is to show that those concerns were addressed in making the decision which led to the approval in the first place thereby minimizing the chances of ANY successful appeal as it then comes down to a determination of facts using the panels discretion to adjudicate any matter before it. VERY HARD to successfully appeal any such determination and the IPP's are smart enough to recognize this, even though J.E., based on his motion, is not bright enough to recognize still, he is fighting a lost battle.
