This shows the desperation of the one remaining intervenor who constantly LOSES at every turn. If he seriously believes that the PUC will reconsider a decision just made due to corporate restructuring, change in contractors or increases in efficiency, which has already been heard by the way Jon during the hearings on the matter by the PUC, then he needs to READ the decisions and testimony of the proceedings before filing such tripe.
The PUC will look at this for 30 seconds and dismiss it's claims and arguments as the garbage it is, denying the motion within 5 minutes of reading it.
Whoever he paid to write it for him did a good job of putting together a written legal argument, unfortunantely, without a factual basis relevent to the approval already made and good reason to attempt to overturn their decision, this will fall on deaf ears.
Let's look at it this way; If any of the arguments had ANY REAL MERIT and a chance for success, who here believes that it would be Jon that would be the one making it and not the IPP's or OCA with DEEP pockets and expert legal council to challenge?
This is just more of the same TIRED stall and delay tactics which the regulatory bodies DO NOT appreciate or tolerate very well.
I'd be willing to bet 5 figures and give odds on top of that, that this will be summarily DENIED the same day it is looked at by the board.
