no surprises there .. they don't need to be reported per the sec
actually you are mistaken but that is okay. it may be convenient to rely on this theory but it makes absolutely no sense. i am not sure what credible person you spoke to at the SEC but the facts are, the DTCC reports out FTD's in bulk daily and that raw data is re-posted to the public. there is no reason to, nor any proof of, certain companies being excluded from publication. I believe, as evidenced by the lists, that MANY non-reporting companies are presented in the list making it illogical that certain scams like this one would be singled out for exclusion.
I believe that like the misuse of short sale volume, this theory is likely another misuse of information.
