IMO Investors who feel they were Conned, first need to go to the SEC complaint section on their website:

http://www.sec.gov/complaint/select.shtml

It's important to file a complaint for many reason but mainly if a Class Action Lawsuit occurs you would be on record as someone who as already went on record with a governing party to voice your concerns.

The more people filing a complaint the better because the SEC is so inundated with fraudulent companies like SUNV that it take them awhile to get to them unless their are hundreds of complaints. This is only my understanding, I'm not an attorney or expert in this area, just an investor who is upset because I feel taken to the cleaners.
