fmi81, the "Subsequent Events" section of the 10k allows for current news, from 12/31/2010 to the date of filing, to be added to it. The date of its filing was 4/15/2011. That gave them plenty of time to include it in the "Subsequent Events" section. I wonder why they didn't.
There has been no word from the company in any form indicating that the Kansas deal has closed. That takes care of past and present, so you must be basing this repetitive "positive cash flow" statement on just your opinion.
