REPORT AND RECOMMENDATIONS re 34 MOTION to Dismiss filed by Moritt Hock Hamroff & Horwitz, LLP, 35 MOTION to Dismiss filed by Raich Ende Malter & Co., LLP, 32 MOTION to Dismiss the action filed by Hamptons Luxury Homes, Inc., Roy Dalene& #096;, Frank Dalene, 36 MOTION to Dismiss MOTION for Summary Judgment filed by Robert A. Wilson: For the reasons contained in the attached Report & Recommendation, I recommend that defendants' motions to dismiss be granted and that plaintiff&# 039;s Amended Complaint be dismissed in its entirety. In light of this recommendation, I further recommend that plaintiff's cross-motion for summary judgment be denied as moot.
