Yeah Markle definately got Daic and Co. to reveal some cards and back themselves into a corner in their response to his filling. Bet they didn't see that one comming. I laughed audibly when I read the following part of Daic and Co.'s response:

1. Plaintiff asks this Court to excuse its inadquate and admittedly late designation of Spencer G. Markle to testify regarding attorneys' fees in this breach of contract case. It's only excuse - oops - we didn't get a new lawyer until after we already missed the deadline. That is not good cause and it does not excuse the inadquate and late designation.

I mean really. Not even a professional courtesy to allow Markle to testify about his own legal fees after joining the case only 3 days before the filling deadline?!?! Man this is rich. Then they pound home the fact that the court noted that there was not to be any contininuance of a deadlines.

If the Judge doesn't throw out all of Daic's witnesses I will be dumb-struck.
