04/04/2011 ORDER GRANTING PLAINTIFF'S 128 Motion to Amend/Correct/Supplement -- The SEC's request for a clarification of the court's March 14, 2011 Order granting a Preliminary Injunction, Accounting and Asset Freeze is GRANTED. Apparently, the Defendants misunderstood the court's March 14th Order. As stated throughout the Order, the Defendants were to provide an accounting "as described in the SEC's proposed Order." (March 14, 2011 Order, at 18, 20-21, 23, 28, 34.) The court's more detailed description provided in Section A.3 of the Order was merely an example as to Spongetech. Accordingly, each defendant is directed to provide the appropriate accounting that identifies ALL of that defendant's assets, income, and liabilities regardless of whether they relate specifically to Spongetech. Defendants are directed to pages 11 and 12 of the SEC's Proposed Order [Docket Entry 2] if they need further clarification. SO ORDERED by Judge Dora Lizette Irizarry on 4/4/2011.
