I am only interested in the SEC determining in finality whether NSS was a factor.

and what pray tell will convince you? should the SEC hold a press release and say we investigated SPNG and while we found no NSS we found the executives guilty of fraud? again S L O W L Y ..... How do you know they have not done this already? you want answers but no enforcement for NSS IS an answer.

If someone is not arrested for robbery, I assume that is because they are not a robber and not simply because the cops never looked for them. I don't expect a press release by the cops making claim they are not a robber. Instead I expect them to say NOTHING.

as for why the SEC is not giving the bankruptcy their material, because their civil case trumps bankruptcy.
